(San Jose, CA) April 10, 2017 – The prominent law firm of Wade Law Group claimed victory Friday when Alameda County Superior Court Judge, Julia Spain entered judgment in favor of the firm’s clients. The firm’s latest case involved an action in which the firm was representing Black Garlic Inc. and its former President, Byong Ha Kim. Both were sued by Plaintiff, Soo Kil Kim, who was seeking to recover over $83,000 in damages, plus attorney’s fees and costs from the firm’s clients.
The lawsuit was initially filed in Los Angeles County but was moved to Alameda County after Wade Law Group argued that the case had been filed in the wrong county. After the case was moved, Wade Law Group took the position that the lawsuit was frivolous because both the statute of limitations had run and because the allegations made in the complaint failed to support a correct legal theory of recovery. Although Plaintiff’s counsel vehemently objected to the firm’s arguments to have the case dismissed, judge Spain agreed with the firm and ultimately granted judgment in favor of the firm’s clients.
When asked how he felt about the victory, Wade stated: I am very happy for our clients. It’s a horrible feeling being wrongfully sued. We hope the Plaintiff will learn a valuable lesson from having filed this lawsuit.
