(Stanislaus County, CA) — June 29, 2026 — David Chon of Wade Litigation secured yet another victory in a contested Stanislaus County probate matter before Judge Stacey Spiller involving disputes over trustee administration and estate management.
The opposing parties sought Wade Litigation’s client’s removal as trustee and executor of the estate, alleging improper financial management, and filed three separate ex-parte applications attempting to suspend the client during the litigation.
Chon responded by filing a petition confirming the client’s actions as trustee and obtaining supporting declarations from the remaining competent beneficiaries. Wade Litigation also conducted a preemptive meet and confer regarding the anticipated suspension attempts, which was later used as evidence against the existence of any emergency requiring ex parte relief.
Throughout the proceedings, Chon successfully defeated all three suspension attempts through rapid responses, documentary evidence, and supporting declarations. At times, Wade Litigation submitted responses the same day and hand delivered courtesy copies directly to the department while continuing to oppose the requested emergency relief.
Chon also argued that the court lacked subject matter jurisdiction to remove the client as executor of the estate, which held the majority of the estate assets. As a result of Chon’s strong litigation tactics, the opposing parties ultimately withdrew their request to remove the client as executor, abandoned the case entirely, and the trial was vacated.
