(Stanislaus County, CA) August 29, 2024 – Steve Derby of Wade Litigation has secured yet another victory. The latest victory occurred in Stanislaus County Superior Court, where Derby first successfully vacated a $251,365 default judgment that had been entered against his client and then subsequently obtained a dismissal with prejudice of all claims.
The case involved allegations of sexual battery, stalking, false imprisonment, and the intentional infliction of emotional distress. The victory is even more impressive since when Derby first accepted the case, he had to figure out how to set aside a judgment that had already been entered against his client. However, through careful investigation, Derby uncovered procedural improprieties and misrepresentations made to the Court during the default proceedings.
He then filed a motion to vacate, which the Court granted on May 7, 2024. Once the judgment was vacated, Derby shifted to his defense strategy, challenging the claims as barred by the statute of limitations. As a result of his efforts, the case was dismissed with prejudice on August 29, 2024.
