(Alameda, CA) — September 15, 2025 – David Chon of Wade Litigation has secured victory in an Elder Abuse case. The latest victory occurred in Alameda County Superior Court before Judge Barbara Dickinson, where Chon protected an estate against a fraudulent transfer of real estate and a subsequent attempt to make a false claim against title.
The case arose after the client’s father, who was suffering from Dementia, had his residence wrongfully transferred to a cousin, who quickly and quietly took out a $100,000 loan against the property. After the father’s passing, the cousin defaulted on the loan and foreclosure proceedings began. Chon initiated probate litigation to pursue the cousin for the residence, as well as the lender for negligence. Chon claimed that the transfer of the property should be reversed because of the decedent’s unsound mind at the time of the transfer.
As a result of litigation, the wrongful transfer of the residence was reversed, the $100,000 encumbrance was removed, and the estate received an additional $16,000 of the cousin’s forfeited cash into the estate.
Sometime after the property was restored, the opposing party later tried to reverse the outcome and reclaim the property as hers. During this litigation, the opposing party attempted to sell the residence to a third party and in response, Chon obtained a court injunction against sale. Chon vigorously objected to opposing party’s attempts and as a result, the court denied opposing party’s petitions, maintaining the estate’s ownership of the residence and remaining loan proceeds.

We were able to protect the estate, undo a wrongful transfer, and ensure that justice was carried through to the end.”
