Wade Litigation Secures DVRO Defense Victory in Merced County (Merced County, CA) September 24, 2025 – Kelly Finley has secured victory in the Merced County Superior Court before Commissioner Shaver, where the Court denied a Domestic Violence Restraining Order (DVRO) sought against her client. The opposing party alleged multiple incidents of sexual assault and physical abuse, including claims of rape and physical force. However, Finley introduced into evidence compelling text messages that revealed the opposing party as the sexual aggressor, including exchanges where she complained about the client’s lack of sexual interest and shared images of sex toys she purchased. During cross-examination, Finley elicited testimony from the opposing party that the parties’ relationship regularly involved consensual BDSM practices.  As a result, the Court found that the opposing party failed to meet her burden of proof, and the DVRO request was denied. This decisive ruling not only protected the client from a serious and damaging allegation but also reinforced the importance of scrutinizing credibility and context in DVRO matters.
