(Orange County, CA) — July 8, 2026 — David Chon of Wade Litigation secured yet another victory in a contested Orange County trust litigation matter involving allegations of fiduciary breach, disputed inheritance obligations, and competing claims concerning the administration of a trust.
The dispute arose after the decedent named Chon’s client as trustee and disagreements developed regarding a beneficiary’s alleged promise to satisfy obligations through his inheritance. Wade Litigation filed a petition to confirm the trust-related issues, after which the opposing party asserted counterclaims alleging fiduciary misconduct and seeking recovery of an alleged prior loan exceeding $300,000.
During litigation, Chon identified and served a statutory notice regarding the trust instrument that prior counsel had allegedly overlooked. The notice ultimately established a significant financial obligation after the opposing party failed to timely contest the issue. Through Chon, Wade Litigation also filed multiple motions in limine seeking to exclude extrinsic evidence related to interpretation of the trust documents.
After the Court issued a tentative ruling indicating that several of Chon’s motions in limine would be granted, the parties reached a settlement during trial resulting in dismissal of all claims asserted against Wade Litigation’s client, approval of attorney’s fees, waiver of future accountings for a three-year period, and a waiver under California Civil Code section 1542.
David Chon was assisted by his paralegal Megan Castro, who Chon claims contributed to the result as a result of her litigation support and case preparation.
