(Santa Clara, CA) — March 26, 2024 – Christine Miller of Wade Litigation has secured yet another victory. The latest occurred in Santa Clara County Superior Court before Judge Manoukian, where Miller successfully obtained summary judgment on behalf of her client in a contested real estate dispute.
The dispute arose when the client, who had purchased a San Jose home, entrusted title to family members with the understanding it would be held on her behalf. Those relatives later transferred the property among themselves and refused to return it, while also failing to pay rent despite continuing to live there. Miller represented the client in a lawsuit to quiet title and recover damages for unpaid rent and loss of use.
Although the case was bitterly contested, very complex, and involved multiple parties and legal theories, Miller was determined to prevail on behalf of her client. Miller prepared a summary judgment motion and cited law and facts in support of her position that judgment should be entered on her client’s behalf without even a trial.
After reviewing the evidence and legal brief of both Miller and opposing counsel, the Honorable Socrates Judge Manoukian, agreed with Miller and granted her motion. For judgment. The court awarded her client sole fee simple ownership of the San Jose property, valued at approximately $1,000,000, as well as a permanent injunction preventing future adverse claims. Additionally, the client was awarded $266,000 in damages for unpaid rent and loss of use dating back to 2018, plus interest.
