(Los Angeles, CA) September 5, 2025 – Steve Derby of Wade Litigation has secured yet another victory. The latest victory occurred in binding arbitration before Hon. Steven J. Kleifield (Ret.), where Derby successfully defended his clients against claims of breach of contract, fraud, and conversion while also prevailing on their cross-complaint.
The case arose after Derby’s clients, a young couple, purchased a Pasadena home for $2.2 million. Derby’s clients raised concerns before the close of escrow that the property had been renovated by the seller without approved plans or permits. To address these concerns, $300,000 from the sale was placed in escrow with the understanding that the seller would provide the necessary permits and approvals.
After the purchase, they discovered undisclosed defects, including a failed septic system and unpermitted renovations. The seller not only failed to fulfil his obligations, but he also refused to release the funds and sued the firm’s clients in Los Angeles Superior Court. The matter was later compelled to arbitration, where Derby filed cross-claims for fraud, nondisclosure, and breach of contract.
On September 5, 2025, the Arbitrator ruled entirely in favor of Derby’s clients, awarding them $667,239.63 in damages and prejudgment interest. The clients were also adjudged the prevailing parties and were allowed to file a motion to seek the recovery of all of their attorneys’ fees of $218,472.59, which is currently pending.
