Wade Litigation Claims Victory Against the City of Los Angeles

(Los Angeles, CA) — July 20, 2023 – Christine Miller of Wade Litigation has secured yet another victory Thursday. The latest occurred when Miller successfully challenged the City of Los Angeles’ Housing Department’s actions which had wrongfully denied her clients the use of their own property.

The clients purchased a triplex in 2020 with the intent of housing family members including an elderly parent.  However, when they sought to follow through on their plan, the City prevented them from reclaiming their units after the City incorrectly designated a tenant as being “protected” from eviction.

The City compounded the problem by issuing an “illegal eviction complaint,” despite no eviction notice ever being served, and insisted there was no appeal process.  Through persistent legal challenges, Miller compelled the City to acknowledge that its actions violated the Los Angeles Municipal Code and conflicted with protections under the Ellis Act.

Ultimately, the City reversed its position, processed the clients’ application, and restored their right to move their family into the property.

Miller was assisted by her trusted paralegal, Gerald Spencer, whose diligent work and support were key in advancing the case. When asked about the outcome, Miller stated: “We are gratified that the city ultimately reversed course in favor of our clients. The prior decision effectively barred them from living in their own property, and this reversal represents a needed course-correction that aligns with both the law and core Constitutional principles.”
