(Stanislaus, CA) — September 15, 2025 – Xochitl Urena of Wade Litigation secured victory yesterday. The latest occurred in Stanislaus County Superior Court before Judge Joseph R. Distaso, where Ureña successfully obtained move-away orders on behalf of her client and child.
The case arose after a mother sought to relocate with her child to Mississippi. The move away was vigorously opposed. On behalf of her client, Urena argued vociferously that the location to which her client wanted to move, had better schools, was more affordable and offered superior family stability. Urena also argued that the opposing party posed safety concerns, since he had already left the child unattended on occasion, had substance abuse issues, and had failed to comply with prior supervised visitation and court-ordered programs.
Moreover, Urena emphasized that the court should allow the move away because her client had sole legal custody, was the established custodial arrangement, and the move was in the child’s best interests in maintaining consistency and stability.
After a contested hearing, the court granted Urena’s client the requested move away, while preserving supervised visitation for the father.
Urena was assisted by her trusted paralegal, Kate Spearman, whose preparation and attention to detail, Urena claims were instrumental in achieving the result. When asked about the outcome, Urena stated: “I was surprised the court ordered the move away. This order occurs after a trial, not prior. The client was also surprised and happy.”
