The latest victory occurred in Los Angeles Superior Court before the Honorable Jonathan L. Rosenbloom, where Ms. Vita successfully negotiated a lucrative settlement in favor of her client in a bitterly contested trust administration matter.
The dispute involved a disagreement between the trustee and the firm’s client, who is a beneficiary, concerning the administration and distribution of trust assets, including, but not limited to, a commercial property used as a car wash and gas station. The litigation also involved alleged prior preliminary distributions, accounting, and reserve issues.
Although the opposing parties had refused to give Ms. Vita’s client what was fair initially, after litigation, Vita was able to demonstrate that her client was likely to prevail on the beneficiary’s claim against the Trust. The confidential global settlement provides for a cash distribution to the firm’s client (resulting from her interest in the commercial property), establishes limited reserves for the opposing party to use as trustee’s fees and attorney’s fees, and exposes the opposing party to potential tax or audit liabilities. It also sets forth defined accounting procedures and enforcement mechanisms. The settlement also includes mutual releases and indemnities to protect both sides from future disputes.
