(Orange County, CA) — June 23, 2025 — Attorney David Chon of Wade Litigation secured a favorable resolution in a contested Orange County trust litigation matter involving allegations of fiduciary breach, disputed inheritance obligations, and claims relating to an alleged $325,000 loan.
The dispute arose after the decedent named Wade Litigation’s client as trustee. Litigation followed regarding an alleged promise by a beneficiary to satisfy obligations through inheritance distributions. Chon filed a petition to confirm the trust-related issues, while the opposing party countersued alleging fiduciary breach and seeking recovery of an alleged prior loan.
During the litigation, Chon identified and enforced a statutory trust notice that prior counsel had allegedly overlooked. After the opposing party failed to timely contest the notice, the missed deadline resulted in a locked-in obligation exceeding $100,000. As trial approached, Chon also filed multiple motions in limine seeking to exclude extrinsic evidence the opposing party sought to rely upon in interpreting the trust instrument.
Chon additionally made an oral motion for nonsuit relating to a primary real estate claim during trial. After the court issued tentative indications that several of Chon’s motions would be granted, the opposing party agreed to settle during trial.
The settlement included dismissal of all claims against Wade Litigation’s client, approval of attorney’s fees, waiver of future accountings for multiple years, and a waiver under California Civil Code section 1542. Chon expressed that he was very pleased with the outcome achieved for the client.
