(Stanislaus County, CA) May 9, 2025 – Steve Derby of Wade Litigation has secured yet another victory. The latest victory occurred in Stanislaus County Superior Court, where all claims against his client, the Mother Lode Mineral Society, were dismissed with prejudice in a lawsuit alleging breach of contract and negligence.
The plaintiff was seeking over $500,000 in damages following a robbery by unknown criminals which occurred at the Stanislaus County Fairgrounds. They sued Derby’s client who were a non-profit organization and its director, Despite multiple amendments to the complaint, Derby successfully prevailed on his belief that a contractual release signed by the plaintiff prior to the event, prevented Plaintiff from bringing the lawsuit.
Each time the plaintiff attempted to proceed, Derby responded with demurrers, and the court consistently agreed that the release barred the claims. Ultimately, following the filing of a third demurrer, the case was dismissed against the firm’s clients, one of whom had passed away before the conclusion of the case.
Derby was assisted by his trusted paralegal, Angie Fayad, whose support, Derby claims was invaluable throughout the proceedings. When asked how he felt about the result of the case, Derby stated: “I was very happy to secure justice for this nonprofit organization of volunteers. The release should have prevented this lawsuit from even being filed, and once it was presented, it should have been dismissed.
